Welcome to Chataboom, a product of Inspired Effect, LLC ("Platform"). Before you start using our services, please carefully read these Terms of Use ("Terms") as they govern your access to and use of our platform. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

1. Description of Service:

Our platform allows customers to share images privately with vendors for the purpose of asking questions and/or making offers.

2. SMS Text Messages:

By signing up as a vendor on Chataboom, you consent to receive SMS text messages at the mobile phone number you provide during registration. These messages are sent to notify you when a customer initiates a chat at your booth. Message frequency varies based on customer activity. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us at chataboom@inspiredeffect.com. Consent to receive SMS messages is required to use the vendor features of our platform, as real-time notifications are essential to the service. We will never share your mobile phone number with customers or third parties for marketing purposes.

3. User Responsibilities:

• You must be at least 18 years old to use our platform.
• You are solely responsible for the images you upload and share on our platform.
• You must not upload or share images that violate any laws, infringe upon the rights of others, or contain explicit or inappropriate content.
• You agree to use our platform in compliance with these Terms and any applicable laws and regulations.

4. Content Guidelines:

• You may not upload, share, or promote any images that contain nudity, sexually explicit content, violence, hate speech, or any content that promotes illegal activities.
• You may not upload or share images that infringe upon the intellectual property rights of others, including copyrights, trademarks, or patents.
• We reserve the right to remove any images that violate these guidelines or are otherwise deemed inappropriate at our sole discretion.

5. Intellectual Property Rights:

By uploading images to our platform, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, and worldwide license to use, reproduce, modify, adapt, distribute, and display the images for the purposes of operating and promoting our platform.

6. Disclaimer of Liability:

Our platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that our platform will be uninterrupted or error-free, or that any defects will be corrected. You acknowledge and agree that you use our platform and access any content at your own risk. We are not responsible for any images uploaded or shared by users, and we do not endorse or guarantee the accuracy, completeness, or quality of any content on our platform.

7. Limitation of Liability:

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of our platform or any content available on our platform. In no event shall our aggregate liability exceed the greater of one U.S. dollars ($1) or the amount you paid us, if any, in the past twelve months for the services giving rise to the claim.

8. Indemnification:

You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including attorneys' fees) arising out of or relating to your use of our platform or any violation of these Terms.
